Owner of Property, defined as the Address above, provides Guest with a license to occupy the Property on the terms and conditions herein, including the House Rules and Business Terms outlined below.
Occupancy and Term: As defined above under Check In, Check Out and Adults/Kids
Rental Amount: As defined above under Total Costs, including tax and cleaning fees.
Rental Deposit (defined as Advanced Payment above): Amount is fully refundable up to 14 days prior to the beginning of the rental period.After said period prior to the rental start date the Owner shall have the right to retain the initial Rental Deposit at the Owner’s discretion.
Maintenance and Repairs: Guest shall maintain the Property in a good, clean, and ready to rent condition, and use the Property only in a careful and lawful manner. The Guests shall leave the Property in a ready to rent condition at Check Out, defined by the Owner as being immediately habitable by the next Guests. Guests shall pay for maintenance and repairs should the Property be left in a lesser condition. The Guests agree that the Owner shall deduct costs of said services from the security deposit prior to refund if Guests cause damage to the Property or its furnishings.
Quiet Enjoyment: Guest shall behave in a civilized manner and shall be good neighbors respecting the rights of the surrounding property owners. The Guests shall not create noise or disturbances likely to disturb or annoy the surrounding property owners. Creating a disturbance of the above nature shall be grounds for immediate termination of this agreement and Guests shall then immediately vacate the premises. Quiet hour starts at 10:00 PM where outdoor noise should be kept to a minimum. Guest shall not trespass onto any neighbors’ property
Parties and Events: Parties and/or events of any kind and size are prohibited at the reserved Property. Guests who violate this policy are subject to suspension or removal without a refund. Any party and /or event that violates the property rules or happens without the knowledge or consent of the Owner is prohibited. In addition, if the guests cause a disruption in the surrounding community, the Owner has full authority to remove a guest without a refund.
Use of Property: Guests expressly acknowledge and agree that this Agreement is for transient occupancy of the Property, and that Guests do not intend to make the property a residence or household.
Restrictions on Property Use: Guests are prohibited from engaging in any unlawful activity or any other activity that constitutes a nuisance. Violation of this provision will result in immediate eviction without refund, and Guest will be held liable for any damages to the Property, contents and grounds. All Guests must comply with the Declaration of Covenants, Conditions and Restrictions for Long Valley Ranch.
Fireworks: Guest agrees that Fireworks and other hazardous materials shall not be used in or around the property.
Illegal Use: Guest shall use the property for legal purposes only and other use, such as but not limited to, illegal drug use, abuse of any person, harboring fugitives, etc. shall cause termination of this Agreement with no refund of rents or deposits.
Shortened Stays and Conditions: There shall be no refunds of rents due to shortened stays or ruined expectations because of weather conditions.
Smoke & Carbon Monoxide Detectors: Guests are required to promptly report inoperative smoke detector(s) and Caron Monoxide detectors to Owner. Inoperative detectors generally produce an intermittant “chirp” or “beep” sound.
Internet: High speed wireless internet is provided as a convience only and is not integral to the Agreement. No refund of rents shall be given for outages, content, lack of content, speed, access problems, lack of knowledge of use, or personal preferences with regard to internet service.
Taxes: Guest agrees to pay any applicable Transient Occupancy Tax levied by the County of Mendocino in the case the platform through which the Property is booked does not collect same.
Possessions: Owner is not responsible for the theft of personal items from the Property. Property Inspections: All problems, including inadequate cleaning and damage, must be reported to Owner within 24 hours of check in for prior guest to be held responsible. Owner reserves the right to enter Property at any time for the purpose of effecting necessary inspections, repairs or maintenance.
Termination: Should the Guest violate any of the terms of this Agreement, the rental period shall be terminated immediately in accordance with State law. The Guests shall vacate the Property on or before Check Out.
Pets: Pets, a maximum of two (2) animals, are allowed the property. Guest must clean up and appropriately dispose of all pet refuse.
Smoking: Smoking is only allowed outside the buildings at the Property. There is no smoking within any structure on the Property. Smoking includes vaping or the use of similar devices.
Trash: Guest shall dispose of all waste material generated during the rental period. Trash receptacles are provided on the outside of the prperty in the refuse storage structure.
Gate Code: Guest may not share the gate code with any invitees or guests. Gate code will provided in a Welcome e-mail prior to Check In. Guest must not use the gate code provided after Check Out.
Assumption of Risk: Guest assumes the entire risk of injuries arising from use of the Property, which includes all structures and all geographic features of the Property, including the pond, field, and trees. Guest understands and aknowledges the risks of bodies of water, which risks include serious physical injury and death. Guest will ensure that all members of Guest’s party, including Guest’s invitees, whether authorized or not, are aware of the risks related to the Property and that any such invitees additionally assume the risk of injury or death by entering the Property. Further, Guest will ensure that the Property has a secure shower or bathtub mat, and that the Guest takes reasonable measures to prevent slips in the bathroom, on staircases, steps, on balconies and throughout the Property. Guest agrees to take a higher degree of care in the use of the Property because of the age of the structures on the Property and the geographic features of the Property.
Limitation of Liability for Personal Injury: The Guests and Guests’ guests and invitees shall hereby indemnify and hold harmless the Owner against any and all claims of personal injury or property damage or loss arising from use of the Property regardless of the nature of the accident, injury or loss. Guests expressly recognize that any insurance for property damage or loss which the Owner may maintain on the property does not cover the personal property of Guests, and that Guests should purchase their own insurance for Guests if such coverage is desired.
Limitation of Liaiblity for Rental: Owner will not be liable for circumstances beyond their control, including but not limited to appliances or air-conditioning/heating failure, other mechanical failure, unfavorable weather, disruption of utility services including cable television, etc. There will be no relocation, rental pro-ration or refund in the event of such circumstances. In the event Owner is unable to deliver the Property to Guest because of Property sale, Owner decision, fire, mandatory evacuation, eminent domain or Acts of Nature, or if the property is unavailable because of construction delays or lack of utilities, Guest agrees that Owner’s sole liability, as a result of any of these conditions, will be a full refund of all payments tendered by Guest. Guest expressly acknowledges that in no event will Owner be held liable for any other condition out of the control of the Owner, or for any incidental or consequential damages, including but not limited to, expenses that result from finding other accommodtaions or for any other losses.
Attorney’s Fees: Guests agree to pay all reasonable costs, attorney’s fees and expenses that shall be made or incurred by Owner enforcing this agreement.
Governing Law: This agreement is governed under the laws of Mendocino County, and the State of California.
No Creation of Tenancy: Guest acknowledges and understands that this Agreement does not create a tenancy for the Property, and Guest’s stay is not controlled by California’s landlord/tenant laws. Guest’s stay will not be extended for a period over thirty (30) days, and there are no holdover provisions to the license granted under this Agreement.
Severability: If any provision of this Agreement is held to be illegal, invalid or unenforceable under present or future laws effective during the term hereof, such provision shall be fully severable and this Agreement shall be construed and enforced as if such illegal, invalid or unenforceable provision had never comprised a part hereof; and the remaining provisions hereof shall remain in full force and effect and shall not be affected by the illegal, invalid or unenforceable provision or by its severance hereof. Furthermore, in lieu of such illegal, invalid or unenforceable provision there shall be added automatically as a part of the Agreement a provision as similar in terms to such illegal, invalid or unenforceable provision as may be possible and still be legal, valid or enforceable.
Waiver: The waiver by either party hereto of a breach of any term or provision of this Agreement shall not operate or be construed as a waiver of a subsequent breach of same provision by any party or of the breach of any other term or provisions of this Agreement.
